OKVED codes for license

When registering society with limited liability The applicant points out in the form of P11001, which activities on OKVED codes it will be implemented. In 2020, digital codes must comply with the All-Russian OKVED-2 classifier.

You can choose when registering a legal entity, you can unlimited OKVED codes, and later you can add them. Is it necessary to obtain permission already on the fact of the indication of the license activity in the statements of P11001 (P13001, P14001) and the register?

In itself, the specification of OKVED codes that correspond to one of licensed species Activities, does not oblige a permission, if in reality you have not proceeded to this business.

However, there is some risk that checking will try to finf by the company if it is engaged in some similar direction. The problem is that the description of the licensed business area and its characteristics in Classifier OKVED It does not always coincide.

For example, there is no term "confidential information" or "information protection" in OKVED, while in Law No. 99-FZ dated 04.05.2011 as many as four licensed activities in this area. But in the classifier there are completely different directions:

  • Computer development software (62.01)
  • Activity Consultative and Computer Technology Works (62.02)
  • Data processing activities, information services and related activities (63.11).

When implementing real activities on these codes, the OKVED can be both having and not have access to confidential information. In such ambiguous cases, answering the question whether LLC license needed, only licensing authorities will be able after analyzing a specific situation. It is desirable that the response of the agency will be given in writing, which to some extent will protect against a possible fine.

If we talk about the types of activities that are not in doubt about the need for their licensing, one cannot be called one OKVED code that fully describes the license direction of the business.

For example, pharmaceutical activity on which the license must be obtained includes the manufacture of drugs, their storage, transportation, vacation, and wholesale and retail medicines.

In OKVED-2, we will find such codes corresponding to pharmaceutical activities:

  • 21.20 - Production of drugs and materials used for medical purposes;
  • 46.46 - Wholesale of pharmaceutical products;
  • 47.73 - Retail sale of drugs in specialized stores.

The same analysis and selection of codes must also be carried out for other licensed areas. You can make it yourself or ask for help for registrars. In some cases, their consultations on the selection of OKVED codes are

In this article we will tell you what types of activity in 2020 it is necessary to obtain a license, and the work threatens without such permission, if it is required by law.

Features of activities requiring license

Directions of business subject to licensing are not accidentally chosen. They all demand special technical Conditions, qualified personnel or may adversely affect the life and health of people, environment, cultural heritage. There are among the licensed areas of business and those related to large financial flows (banks, credit organizations, stocks and bods market).

Individual entrepreneurs are not available all licensed activities. Why so, the laws do not explain, but it is known that the state refers to the PI as to business kids. For entrepreneurs and fines at times lower, and tax benefits are greater. But, for example, licenses for the production and sale of strong alcohol, IP will not be given. Maximum that will be allowed to sell from alcohol is.

What activity needs a license

The largest list of licensed species is contained in Law No. 99-FZ dated 04.05.2011, but besides him, there are several other laws, each of which regulates a separate direction.

Responsibility for the lack of license

Failure to comply with licensing legislation is an administrative offense, which for II is punishable in accordance with the CFA Articles of the Russian Federation /

Fine for work without a license

  • 14.1 (2) - from 4 to 5 thousand rubles with a possible confiscation of manufactured products, implements of production and raw materials (activities without a license);
  • 14.1 (3) - from 3 to 3 thousand rubles (non-compliance with the necessary licensing requirements);

Special fines for a license in the field of transport under Article 14.1.2 of the Administrative Code of the Russian Federation are much higher:

  • the absence of a license is 100 thousand rubles with the confiscation of the vehicle;
  • violation of the terms of the license issued - 20 thousand rubles;
  • rough violation of the conditions of the license issued - 75 thousand rubles.

Although the size of penalties for II is several times lower than for Ltd., but criminal liability does not have differences depending on the organizational and legal form. It comes upon receipt of income or damage to the state or citizens in the amount of from 2.25 million rubles (Article 171 of the Criminal Code of the Russian Federation).

OKVED and License codes

About how the IP will do, the applicant reports when registering in the tax inspectorate. Digital codes in OKVED (all-Russian classifier of types of economic activity) are applied to designate specific activities.

To compare the list of OKVED codes of activities to be licensed in Russia is impossible. The fact is that licensed directions are wider than the specific OKVED code.

How to determine if licensing OKVED falls

For example, if you choose educational activities, then it will correspond to the following codes from OKVED-2:

  • 85.11: Pre-school education
  • 85.12: Education primary general
  • 85.13: Main general education
  • 85.14: secondary education
  • 85.21: Professional Middle Education
  • 85.22: Higher education
  • 85.23: Preparation of highly qualified personnel
  • 85.30: Training Professional
  • 85.41: Education Additional Children and Adults
  • 85.42: Professional Additional Education

Moreover, it is only four-digit codes, and if you consider five-digit and six-digit, there will be even more. And if we take pharmaceutical activity, then this concept includes the sale of drugs, and their storage, and the manufacture of medicines for recipes.

In itself, the indication in the form of P21001 OKVED codes corresponding to the licensed direction does not oblige a license to receive. Only if the entrepreneur proceeds to real activities, it is necessary to contact the licensing authority in advance.

However, some inspectors, and sometimes banks, are interested, whether you have a license if you are issued if the corresponding oKVED codes. If you are not going to work under license, then for your own calm it is not necessary to inspect these codes in advance when registering SP. Later they can always be given.
