MIOO certification issues, labor safety training manager. Application

Certification of heads of educational institutions in 2019 involves some activities aimed at assessing the qualifications of an employee, his skills, knowledge and experience. For heads of educational institutions subordinate to the Ministry of Education and Science, it is carried out at least once during the period of validity of the employment contract. As for the assessment of suitability for the position held, it must take place within a year after the manager takes office.

The rules for conducting certification, the list of persons exempt from passing it, and other details of this event are stipulated in several regulations. For example, in the Law on Education dated December 29, 2012 No. 273-FZ, Order of the Ministry of Education and Science of Russia dated March 16, 2015 No. 240 and others.

Procedure for certification

The assessment consists of two successive stages: studying the provided documents and an interview. For this purpose, the relevant department creates an attestation commission, prepares a list of candidates, as well as the necessary papers. Documents are then requested from candidates. The commission determines its work procedure independently.

Seven working days before the start, the candidate is notified of the verification by telephone or mail. The notice shall indicate the date, time and place of the knowledge test. If the person being certified does not appear at the specified time without a good reason or prior refusal, he will be subject to disciplinary liability, and the event will be postponed.

MIOO: certification of managers and candidates

On the official website of the Moscow Institute of Open Education (MIOO), you can familiarize yourself with the procedure for conducting a knowledge test, as well as submit an application to pass it. To do this, you need to fill out a form on a special page. It contains basic information, contact details of the subject and attaches scans of the required documents.

What is needed for certification

The candidate or current head of the institution must provide a set of documents specified in the Order. All of them must be in Russian. Among them:

  • report on activities in a leadership position - the results of the development program;
  • certificate of compliance of the manager with the requirements of Part 1 of Art. 351.1 Labor Code of the Russian Federation;
  • consent to conduct an assessment - includes contact information, a list of documents provided, etc.;
  • consent to review and study the provided documents;
  • the opinion of the collegial governing body of the educational institution based on the results of studying the submitted report.

Other documents that contain information useful to the commission may also be provided. In addition, candidates for the position of manager must provide a certificate of no criminal record. The list varies depending on the jurisdiction of the educational institution. The table below contains a list of documents required to pass certification in departmental educational institutions.

If any documents were not submitted in full or were not submitted, the examinee is excluded from the assessment.

Who is exempt from passing

According to the Order and Law dated December 29, 2012 No. 273-FZ, the following are exempt from inspection:

  • managers appointed to positions by the President or the Government of the Russian Federation;
  • have worked in their position for less than one year;
  • pregnant women;
  • women on maternity leave;
  • persons on parental leave until the child reaches the age of three.

As for the last two categories of workers, their knowledge is assessed no earlier than a year after leaving leave.

Depending on which department the institution is subordinate to, the frequency of inspections varies. For example, testing the knowledge of the management of educational institutions under the jurisdiction of the Federal Air Transport Agency, the Ministry of Justice, the FANO, and the Federal Customs Service takes place every five years.

Certification results

If the results of the inspection reveal that the head of the institution does not meet the existing requirements, he will be able to go through it again. Re-evaluation is carried out on the basis of the examinee’s application. In this case, the commission can authorize or refuse the inspection. In case of refusal, the manager is suspended from performing his duties until the certification is successfully completed.

If the commission decides that the head of the organization is not suitable for his position, he can be dismissed on the basis of clause 3 of part 1 of Art. 81 Labor Code of the Russian Federation.

Industrial safety certification of managers and specialists

Industrial safety certification of managers and specialists of educational institutions is not carried out, since only specialists working at industrial and construction sites, as well as hazardous industries, must undergo it. Employees of organizations subordinate to Rostechnadzor must also undergo such an assessment.

The recently increased powers of managers heading large educational complexes determine the requirements for their level of competence and experience in the professional implementation of management functions. The formation of a professional corps of managers of educational organizations is determined by a set of measures, among which certification for suitability for the position has become a basic component.
Federal Law No. 273-FZ “On Education in the Russian Federation” legally established the obligation to undergo certification for compliance with the position of head of an educational organization. According to Art. 51 clause 4, the procedure and timing of certification are established by the founders of educational organizations.
In Moscow, the application of Article 51 of Federal Law-273 is regulated by the Regulations on the procedure for certification of managers and candidates for positions of heads of state educational organizations subordinate to the Department of Education, approved by order of the Department of Education dated April 30, 2015 No. 201 (as amended by orders dated May 26, 2015 No. 241, dated June 9, 2015 No. 293). This document determines the procedure for conducting mandatory certification of managers and candidates for the positions of heads of state educational organizations subordinate to the Department of Education, implementing educational programs of preschool, primary general, basic general, secondary general, secondary vocational education, basic vocational training programs, additional general educational programs, additional professional programs.
Certification is one of the most effective personnel technologies that allows us to establish the level of compliance of the current head or a candidate for the position of head of an educational organization with the requirements for this position. The basic principles of certification are transparency, openness, and collegiality.
Certification of managers and candidates is carried out by a certification commission created by the Department of Education. The personal composition of the certification commissions and their number are approved by order of the department. Since May 2015, the Moscow Institute of Open Education has been providing support for the certification procedure. Certification of managers and candidates is carried out in two stages: qualification tests in the form of testing and an interview with the certification commission.
The new Procedure involves optimizing the certification procedure, reducing time costs and regulating the actions of all participants in this process, from submitting an application for certification to an interview with the certification commission. Certification of both candidates and managers is carried out on the basis of a personal application in the form of an electronic document sent to the organization accompanying the certification procedure - MIOO. The procedure defined by the new Procedure is designed to purposefully increase the manager’s responsibility for his certification and, accordingly, for its results.
In Moscow, the Department of Education is systematically forming a personnel reserve for heads of educational organizations, which in turn involves mandatory certification of candidates for the position of head.
According to the Procedure, a candidate may be denied the certification procedure if:
- grounds preventing the engagement in teaching activities and restrictions on employment in the field of education;
- termination of the employment contract under Article 81, paragraphs 3, 5, 8, 9-11; under Article 278, paragraph 2 of the Labor Code of the Russian Federation - within two years from the date of termination;
- lack of special training provided for by the EKS requirements and work experience in teaching positions.
However, a candidate who does not have special training provided for by the requirements of the EKS and (or) professional standards, but who has sufficient practical experience in teaching activities in the Moscow education system and professional competence, may be admitted to certification. In this case, the candidate must provide a review from the employer containing an assessment of the candidate’s professional activities, taking into account its effectiveness and significance for the development of the educational organization.
For current heads of educational organizations in the course of their work activities, both regular and extraordinary certification are possible.
Extraordinary certification is carried out during the inter-certification period:
- or by decision of the Department of Education due to low performance indicators of the educational organization, in the presence of justified complaints, based on the results of inspections, as a result of which violations were identified;
- or by personal decision of the head of the educational organization.
Based on the results of the extraordinary certification, a new validity period for its results is established. The previously established certification period is terminated.
A manager sent for extraordinary certification submits an application to the certification commission no later than five working days after receiving notification of certification. In the application for extraordinary certification, the manager indicates the date of passing the qualification tests, which should not exceed 30 calendar days from the date of receipt of the notification of certification.
Today, restrictions on the deadlines for submitting applications for the next certification have been lifted for heads of educational organizations, however, the head should be careful not to be late in submitting the application, since the duration of the certification procedure is no less than one and no more than four months from the date the organization received the application, accompanying the certification procedure, before the certification commission makes a decision.
The changes also affected the qualification testing stage. Qualification tests are carried out in the form of computer testing. The new Procedure provides for the possibility of two testing attempts for both managers and candidates; according to the previously effective Procedure, a manager could be tested only once.
If the test results are less than 70% of the overall quality of the test and (or) less than 50% in one of its modules, the certification procedure for the candidate is terminated, the certification commission does not consider his candidacy at the meeting.
But for a manager, this result leads to more severe consequences. In case of failure to pass the first stage of certification (testing), the manager is not admitted to the second stage of certification (interview with the certification commission) and is recognized by department order as not corresponding to the position held.
Approaches to test formation have changed. According to the new Order, the test consists of two parts: invariant and variable. That is, each test taker is certified in two mandatory modules and three modules that they can choose from the proposed list.
The invariant part includes the modules “State policy in the field of education” and “Legal foundations of management”.
The variable part is represented by the modules “Financial and economic foundations of management”, “Business administration”, “Educational technologies”, “Functional responsibilities in the administrative team of an educational organization”, “Ensuring the safety of the educational process”, “Organization of the educational process”, “Use of information systems in management of an educational organization”, “Organization of financial and economic activities of an educational organization”.
The number of variable modules is not constant. The choice of the variable part of testing is made by the person being certified when submitting an application for certification. The clause of the Certification Procedure, which determines the possibility of selecting testing modules, comes into effect from the beginning of the new academic year, that is, from September 1, 2015.
The preferences for heads of schools included in the rating have also changed somewhat. In the new academic year, educational organizations that take the first 300 places in the ranking based on the results of educational activities are taken into account. Managers of the top twenty rankings are exempt from qualification tests when passing certification.
Heads of schools ranked from 21st to 70th position in the ranking are tested in only one module - “State policy in the field of education”; from 71st to 170th place - in the modules “State policy in the field of education” and “Legal foundations of management”; from 171 to 300 - in the modules “State policy in the field of education”, “Legal foundations of management” and in one of the variable modules.
In case of extraordinary certification at the initiative of the employer, the manager undergoes qualification tests in all modules, in the case of certification on personal initiative - testing in modules in accordance with the position of the educational organization in the ranking.
In accordance with the new Procedure, each person being certified must be personally present at the commission meeting. At the same time, for each person being certified for the work of the certification commission, a certification certificate is prepared based on information obtained from the information and analytical systems of the Department of Education and information provided by the person being certified. The test results are also included in the certification certificate, and in relation to the leader being certified, additionally - proposals from the Department of Education and the chairman of the interdistrict board of directors on the period for which the leader can be certified.
The certification commission reviews the certification certificate, conducts an interview with the certified person and makes one of the decisions:
- “corresponds to the position of the head of an educational organization”;
- “corresponds to the position of the head of an educational organization, taking into account the recommendations”;
- “does not correspond to the position of the head of an educational organization.”
The head of an educational organization is certified for a period of up to 5 years. If, during the certification of a manager, the certification commission makes recommendations, the validity period of the certification results is 2 years.
The certification period for a candidate for a manager position is 2 years, regardless of the availability of recommendations from the certification commission.
Changes in the certification procedure are natural and set by the vector of development of the entire Moscow education system. The modern head of a metropolitan school is a leader who sets and implements all changes aimed at improving both the system itself and the management corps.

The head of a modern Moscow school is incredibly determined. Even taking into account the attractive salary, not everyone in such a position will agree to work daily in multitasking mode, bear a huge load and responsibility on their shoulders, or find unconventional solutions to emerging problems. Nevertheless, the flow of those wishing to head the school does not dry out.

Go to school only with experience

The path to becoming a director is multi-stage. Those who have no restrictions on working in the field of education and have a management diploma join it. The candidate's pedagogical education is not a prerequisite.

“It is normatively determined that the manager must have a higher professional education in the areas of training “State and municipal administration”, “Management”, “Personnel management” and work experience in teaching positions for at least five years,” explains Rector of the Moscow Institute of Open Education (MIOO) Alexey Rytov. - Or the second option: higher professional education and additional professional education in the field of state and municipal administration or management and economics. And also work experience in teaching or management positions for at least five years. Please note: the lack of pedagogical education in the requirements is compensated by the presence of experience in pedagogy, because even a person with excellent management knowledge often finds it difficult to understand some of the features of the functioning of such a complex organism as a school.”

Live exam

Candidates will undergo certification in two stages.

The first qualification test takes place in the form of computer testing. Within one hour, you must answer 40 questions related to the management of personnel, resources, processes, results and information. The questions are formulated to describe everyday situations that may arise.

For example, “How is the volume of a subsidy for the implementation of a state task determined in terms of expenses for maintaining the property of an educational organization?”

Or a question from the field of information management: “The biology teacher at your school was among the finalists in an international competition. A TV channel correspondent contacted the school and wanted to arrange a recording of the interview. To prepare, he needs information about the hero. What information do you have the right to give to a correspondent without the personal consent of the biology teacher?”

Resource management task: “The school needs to purchase interactive whiteboards. The contract manager scheduled the auction in accordance with the requirements of the law, forming a starting price based on the commercial proposals received. What needs to be analyzed to understand the correctness of pricing?

Since the manager must build management based on the regulatory framework, only clear answers with reference to specific documents are acceptable during testing.

Director candidates devote several months to preparing for this stage. They call the materials posted on the MIOO website a serious help: texts of documents, lists of references and a demo version of the test. By the way, the test is publicly available and any website visitor can take it.

The second stage of certification (for those who have passed the first) is an interview at the Department of Education with members of the Certification Commission (consisting not of officials, but of school directors) and secret electronic voting. This process takes place live on the Internet, video recording is made, after which the videos are posted on the department’s website. Such openness, firstly, eliminates any questions about the transparency of the procedure, and secondly, the records act as a kind of teaching aid for future candidates.

Not everyone will get a contract

However, it is too early for excellent students who have scored the required points to occupy the director’s office.

“I would like to draw attention to one point that lies in the legal field of labor relations. It is impossible to sign or extend an employment contract with the head of an educational organization who has not passed certification, notes Head of the Department of Education of the capital Isaac Kalina. - However, the passed certification of a school director or a candidate for this position is not an automatic obligation to sign or extend an employment contract. Certification is one of the conditions, but not a universal pass to become the head of a capital school.”

Ivan Dorodnov has been trying himself as a school principal in the Mitino region for a month now. He is 28 years old. In the recent past, he is a teacher of physics and computer science. However, he plans to continue teaching in a leadership position.

The initiator of his nomination as a candidate for certification was the leadership of his previous school. Fellow teachers, knowing Dorodnov’s skills as chairman of the school trade union organization, assumed that such an outcome was possible.

“During preparation for certification, I realized that the new position would be more difficult than I thought,” he does not hide Acting Director of School No. 1747 Ivan Dorodnov. - The level of responsibility increases greatly. The director's actions are multipolar, you must be everywhere and anywhere. I met the team and had our first meeting. I came to school in the summer, so I delve into the current repairs and everything that is not directly related to educational activities.”

There is also a certification procedure for those who replace the head of the school during his absence. Since 2013, 2,242 people have completed testing and interviews for this purpose. Deputy directors, teachers, methodologists, educational psychologists, speech therapists undergo exactly the same tests as the future director!

“During the interview, the commission asked me a question about how I see the school of the future,” recalls a recently certified history teacher of school No. 1293 Natalya Klimova. - At this moment I had to quickly find my bearings so as not to miss anything in my answer.

I had administrative experience in the past, and passing the certification allowed me to take the position of deputy director for educational content. This work is colossal, so it is simply impossible to work as a teacher full time - something will suffer. But I would like to teach history for a few hours a week.”

In addition, current school directors are certified for suitability for the position. Positive results during two stages guarantee them the right to head the school further.

However, according to statistics, over the last four years, 98 managers were not certified - 56 did not pass the test, 42 did not pass the interview.

“With a manager who is not certified for the position, the employment contract is terminated; this is a requirement of the law,” sums up Alexey Rytov. - And yet, termination does not become a limitation for further self-improvement. Typically, managers who fail apply as candidates and pass the certification threshold.”

I. General provisions

1.1. These Procedures and terms for the certification of candidates for the position of head and head of an educational organization under the jurisdiction of the Ministry of Education and Science of the Russian Federation (hereinafter referred to as the Procedure) determine the procedure for the certification of candidates (candidates) for the position of head and head of an educational organization under the jurisdiction of the Ministry education and science of the Russian Federation, and the timing of its implementation (hereinafter referred to as certification, candidates, heads of educational organizations, Ministry).

1.2. The objectives of certification are:

a) increasing the efficiency of selection and placement of heads of educational organizations;

b) assessment of the knowledge and qualifications of candidates (candidates) for the position of head of an educational organization;

c) assessment of the knowledge and qualifications of heads of educational organizations and confirmation of their suitability for the position held;

d) stimulating the professional growth of heads of educational organizations.

1.3. The following are subject to certification:

a) candidates (candidates) for the position of head of an educational organization;

b) heads of educational organizations.

1.4. Heads of educational organizations are not subject to certification:

appointed to a position by the President of the Russian Federation or the Government of the Russian Federation;

have worked in their position for less than one year;

pregnant women;

women on maternity leave (their certification is carried out no earlier than one year after leaving leave);

persons on parental leave until the child reaches the age of three (their certification is carried out no earlier than one year after leaving leave).

1.5. Certification of heads of educational organizations is carried out at least once during the period of validity of the employment contract. Certification of the manager in order to confirm compliance with the position held is carried out within a year after appointment to the position.

1.6. Certification is carried out in Russian and consists of the following sequential stages: analysis of submitted documents and materials about the candidate for the position of manager (manager) and interview.

1.7. To carry out certification, the Ministry:

a) creates an Attestation Commission to conduct certification of candidates for the position of head and heads of educational organizations (hereinafter referred to as the Attestation Commission);

b) forms lists of candidates for the positions of heads of educational organizations subject to certification on the basis of proposals received in the prescribed manner, including from the permanent advisory body of the Ministry, which considers issues of staffing of educational organizations of higher education under the jurisdiction of the Ministry (hereinafter referred to as the advisory body) ;

c) compiles lists of heads of educational organizations subject to certification;

d) determines the certification schedule;

e) prepares the necessary documents for the work of the Certification Commission;

g) requests from candidates (candidates) for the position of head, head of an educational organization, as well as relevant organizations, advisory bodies the documents, materials and information necessary to ensure the activities of the Certification Commission;

h) exercises other powers in order to ensure the activities of the Certification Commission.

1.8. The Certification Commission operates on a voluntary basis.

1.9. The main principles of the Certification Commission are competence, objectivity, transparency, independence, and compliance with professional ethics.

1.10. Methodological, analytical, organizational and technical support for the activities of the Certification Commission is provided by the structural unit of the Ministry, which is entrusted with these functions.

II. Functions, powers, composition and work procedure of the Certification Commission

2.1. Certifying commission:

conducts certification of candidates (candidates) for the position of head of an educational organization;

conducts certification of heads of educational organizations;

carries out an analysis of the submitted materials in relation to candidates (candidates) for the position of head and head of an educational organization, including checking their compliance with the qualification requirements specified in the qualification reference books for the relevant positions of heads of educational organizations and (or) professional standards, the absence of grounds preventing employment pedagogical activity, and restrictions on employment in the field of education, conducts a comprehensive and objective study of candidates for appointment to the position of head of an educational organization.

2.2. The certification commission has the right:

a) request from candidates (candidates) for the position of head, head of an educational organization, as well as relevant organizations, advisory bodies, documents, materials and information necessary for its activities;

b) establish deadlines for the submission of requested documents, materials and information;

c) conduct the necessary consultations;

d) create working groups with the involvement of experts and specialists, the composition of which is approved by the Certification Commission;

2.3. The composition of the Certification Commission is approved by order of the Ministry.

The Certification Commission includes representatives of the Ministry, representatives of federal government bodies, representatives of public organizations, representatives of trade union organizations, representatives of government bodies of the constituent entity of the Russian Federation on the territory of which the organization is located *(1), as well as members of supervisory boards of autonomous organizations and members of the advisory organ *(2) .

The Chairman of the Certification Commission is the Minister of Education and Science of the Russian Federation.

The Chairman of the Certification Commission carries out general management of the activities of the Certification Commission, presides at its meetings, organizes the work of the Certification Commission, exercises general control over the implementation of decisions made, and distributes responsibilities among the members of the Certification Commission.

The deputy chairmen are the Deputy Minister of Education and Science of the Russian Federation and a representative of a public organization. In the absence of the chairman of the Certification Commission, the duties of the chairman are performed by one of his deputies, who is entrusted with such duties by the chairman of the Certification Commission.

The Deputy Chairman of the Certification Commission, in the absence of the Chairman of the Certification Commission, performs the functions of the Chairman of the Commission in full.

The executive secretary of the Certification Commission is a representative of the Ministry.

The executive secretary of the Certification Commission prepares materials and draft decisions of the Certification Commission, sends requests and notifications on behalf of the Certification Commission, and ensures that the decisions of the Certification Commission are forwarded to educational organizations.

2.4. The certification commission independently determines the procedure for its work.

The main form of activity of the Attestation Commission is meetings. Its members are notified of the place, date and time of the meeting of the Certification Commission by letter or telephone message.

A meeting of the Attestation Commission is considered valid if at least half of the total number of its members are present.

Decisions of the Attestation Commission are made by open voting by a simple majority of votes present at the meeting. In the event of a tie of votes, the decision voted for by the chairperson at the meeting of the Certification Commission is considered adopted. At the proposal of members of the Attestation Commission, a decision may be made by secret ballot.

The decisions of the Certification Commission are documented in protocols, which are signed by the chairman of the Certification Commission or his deputy, who chaired the meeting of the Certification Commission, and the executive secretary of the Certification Commission.

A member of the Attestation Commission who does not agree with the decision made has the right to express his dissenting opinion in writing, which is attached to the minutes of the meeting of the Attestation Commission.

Decisions of the Certification Commission made on candidates (candidates) for the position of head of an educational organization or the head of an educational organization, in the form of an extract from the minutes, within seven working days from the date of the meeting of the Certification Commission are sent to the educational organization, as well as, accordingly, to the candidate for the position of head or the head of an educational organization.

IV. Carrying out certification

4.1. Proposals for candidates (candidates) for the position of head of an educational organization and materials on them are submitted to the Certification Commission:

b) a structural unit of the Ministry that implements personnel policy, in agreement with the structural unit of the Ministry that coordinates the activities of the educational organization.

Proposals for candidates (candidates) and materials must be submitted to the Certification Commission no later than 60 calendar days before the expiration of the term of office of the current head of the educational organization (in case of early termination of his powers - within 15 working days) and/or within the time limits established by the Ministry .

4.2. Materials for certification of the head of an educational organization are submitted to the Certification Commission directly by the head or his authorized person within the time limits established by the Ministry.

4.3. A set of materials for a candidate for the position of head of an educational organization is drawn up in Russian and must include:

a candidate’s application with a request for his certification by the Certification Commission and consideration of his documents (indicating his contact phone number, place of residence and email (if available), attached documents);

the candidate’s statement of consent to the verification and processing of the submitted information about the candidate;

information about the candidate in accordance with the appendix to the Procedure;

development program of the relevant educational organization, as well as the main provisions of the program of the candidate for the position of head of the educational organization (no more than 2 pages);

an extract from the decision of the authorized collegial management body of the educational organization on including a candidate in the list of candidates for the position of head of the educational organization (in the event that the educational organization submits proposals for candidates for the position of head of the educational organization);

submission of the supervisory board of an autonomous organization on a candidate for the position of manager in the case provided for by the organization’s charter;

a certificate of the presence (absence) of a criminal record and (or) the fact of criminal prosecution or the termination of criminal prosecution on rehabilitative grounds; *(4)

consent of the relevant commission on compliance with the requirements for official conduct of state or municipal employees and the resolution of conflicts of interest; *(5)

certified copies of documents on the appropriate level of education and (or) qualifications, academic degree, academic title;

additional documents at the candidate's discretion.

4.4. A set of materials for the head of an educational organization subject to certification is drawn up in Russian and must include:

a statement from the head of the educational organization agreeing to conduct his certification by the Certification Commission and review his documents (indicating the contact phone number, residential address and email (if available), attached documents);

statement from the manager of consent to check and process the information provided about the manager;

a report on the results of the implementation of the development program of the educational organization and the report of the head for the corresponding calendar year (hereinafter referred to as the report);

an extract from the decision of the authorized collegial management body of the educational organization on the results of consideration of the report;

a certificate of the presence (absence) of a criminal record and (or) the fact of criminal prosecution or the termination of criminal prosecution on rehabilitative grounds * (6) ;

additional documents at the discretion of the manager.

4.5. Candidates for the position of head and heads of educational organizations, documents and materials for which were not received, were not received in full, later than the established deadlines, or comments on the documents and materials of which were not eliminated within the established period, are not allowed for certification by decision of the Certification Commission.

4.6. Candidates for the position of head of an educational organization and the head subject to certification are notified by mail or telephone no later than 7 working days before certification of the place, date and time of certification.

4.7. Certification is carried out with the invitation of the manager to a meeting of the Certification Commission. If a manager fails to attend a meeting of the Certification Commission without a valid reason or refuses certification, he will be subject to disciplinary action in accordance with the legislation of the Russian Federation, and the certification will be postponed to a later date.

4.8. Candidates for the position of manager and heads of educational organizations in respect of whom, at any stage of certification, it was revealed that they do not meet the established qualification requirements or professional standards, or that they have restrictions on engaging in teaching activities, or restrictions on working in the field of education, or a violation of the established in accordance with with the charter of the educational organization of the procedure for nominating a candidate for the position of head, or forgery of submitted documents, by decision of the Attestation Commission are recognized as having not passed the certification and are not allowed to participate in its other stages.

4.10. In case of non-participation in the interview, the candidate for the position of manager, as well as the head of the educational organization, is recognized by the Certification Commission as having failed the certification.

4.12. If a candidate for the position of head of an educational organization or head of an educational organization receives a negative result during an interview, the Certification Commission makes the appropriate decision:

on recognizing a candidate for the position of head of an educational organization or head of an educational organization as having failed certification;

on recognition of the head of an educational organization as having failed certification and his inadequacy for the position held.

4.13. In case of a positive result during the interview of a candidate for the position of head of an educational organization or head of an educational organization, the Certification Commission makes the appropriate decision:

on the certification of a candidate for the position of head of an educational organization and on the recommendation to the Ministry of Education and Science of the Russian Federation to appoint a candidate to the position of head of an educational organization;

on the certification of a candidate for the position of head of an educational organization and his inclusion in the personnel reserve of the Ministry of Education and Science of the Russian Federation to fill positions of heads of educational organizations (hereinafter referred to as the personnel reserve);

on the certification of the head of the educational organization and his suitability for the position held.

4.13.2. The grounds for exclusion from the personnel reserve are:

a) personal statement;

b) appointment to the position of head of an educational organization;

c) continuous stay in the personnel reserve for five years;

d) death (destruction) of a citizen or recognition of a citizen as missing or declaring him dead by a court decision that has entered into legal force;

e) recognition of a citizen as incompetent or partially capable by a court decision that has entered into legal force;

g) the presence of grounds preventing the engagement in teaching activities and restrictions on employment in the field of education;

h) recognition of a citizen as completely incapable of working in accordance with a medical certificate issued in the manner established by federal laws and other regulatory legal acts of the Russian Federation.

4.14. Based on an application from the head of an educational organization that has not passed certification, the Certification Commission has the right to make a decision on re-certification. The head of the educational organization is notified of the place, date and time of certification in accordance with this Procedure.

4.15. The head of an educational organization who has not passed the certification within the established time frame and in respect of whom a decision has not been made on re-certification is suspended from work by order of the Ministry for the entire period of time until the successful completion of the certification, with the Ministry designating the acting head of the educational organization.

4.16. The head of an educational organization, in respect of whom the Certification Commission made a decision on his inadequacy for the position held, may be relieved of his position (dismissed) in accordance with the labor legislation of the Russian Federation.

Candidates for the position of head of a state or municipal educational organization and its head (with the exception of heads of federal universities and heads of educational organizations, in cases established by federal laws) undergo mandatory certification.

This means that the certification of candidates for the position of head of an educational organization is a legislative necessity, the procedure and timing of which are established by the founder of this educational organization.

But as for current managers, the Law, unlike the certification of teaching staff, does not contain any instructions on the frequency of their certification, but only records the very fact of certification, the procedure and timing of which are established by the founders of these educational organizations.

In accordance with the law, the founder has the right to establish not only any procedure for conducting certification of the manager, but also any frequency.

In particular, the founder has the right to completely exclude the periodic conduct of regular certification, while maintaining the obligation to conduct an extraordinary one.

The reasons for its implementation may be:

— repeated violations by the head of the current legislation, confirmed by documents;

— repeated violations by the manager of his job description, documented;

In practice, as an analysis of regulations at the regional and municipal levels shows, in the vast majority of cases, the founders set for managers the frequency of undergoing regular certification for compliance with the position held once every five years (there are also those who reduce this period to three years). Let's try to find out how advisable it is to conduct periodic (regular) certification of current managers.

Currently, there is a tendency to conclude fixed-term employment contracts with managers for a period of up to five years. The basis for this is Part 2 of Art. 59 of the Labor Code of the Russian Federation.

At the same time, the very fact of renewing the contract with the manager for the next term means that the activities of such a manager are completely satisfactory to the founder. In other words, the manager with whom the contract was renewed corresponds to the position held from the founder’s point of view.

But then why do we need periodic certification of managers? After all, if the founder has reasonable doubts about the manager’s suitability for the position held, then he initiates an extraordinary certification in the manner and within the time frame established by him.

With this approach to organizing the certification procedure, the founder will have to organize and conduct certification of only candidates for the position of manager and unscheduled certification of current managers (p An example of the Regulations on the certification of candidates for positions and heads of educational organizations is given in Appendix 1 to the article).

As for the use of the motivational potential of the certification procedure in order to stimulate the professional growth of managers, it can be implemented in the form of voluntary certification for compliance with regional (municipal) qualification levels.

Such levels can be formulated based on performance criteria in the context of the transition to an efficient contract, but that, as they say, is another story.

Appendix 1. Regulations on the certification of candidates for positions and heads of educational organizations

1. General Provisions

1.1. This Regulation has been developed in accordance with Part 4 of Art. 51 of the Federal Law “On Education in the Russian Federation”.

1.2. These Regulations determine the procedure and timing of certification of candidates for positions and heads of educational organizations.

For the purposes of applying these Regulations, the positions of heads of educational organizations include positions classified as “Managers” of the Nomenclature of positions of teaching staff of organizations engaged in educational activities, positions of heads of educational organizations (Resolution of the Government of the Russian Federation of August 8, 2013 No. 678).

1.3. Certification is carried out on the basis of an objective assessment of the professional activities of managers and applicants for the position in order to determine their suitability for the position of “Head of an educational organization.”

1.4. The main principles of certification are: collegiality, transparency, openness, objectivity, and non-discrimination.

1.5. Candidates for the position of head of an educational organization are subject to mandatory certification before appointment to the position.

1.6. Heads of educational organizations undergo mandatory (extraordinary) certification when:

— repeated violations of current legislation by them, confirmed by documents;

— repeated violations of their job descriptions, confirmed by documents;

- negative dynamics of the results of students mastering the implemented educational programs in comparison with previous periods, confirmed by documents;

— justified, confirmed complaints from students (their legal representatives) about the low performance indicators of the educational organization.

2. Certification commission

2.1. Certification of candidates for positions and heads of educational organizations is carried out by an attestation commission consisting of: chairman, deputy chairman, secretary and members of the commission formed by a local government body (authorized government body of a constituent entity of the Russian Federation).

2.2. The chairman of the certification commission is the head (person authorized by him) of the municipal (regional) body exercising management in the field of education.

2.3. The certification commission includes employees of the municipal (regional) body exercising management in the field of education, a representative of the municipal (regional) organization of the trade union of workers of public education and science of the Russian Federation, heads of educational organizations, as well as representatives of scientific, educational and other organizations invited by the chairman of the certification commission as independent experts. The composition of the commission is annually approved by an administrative act of a local government body (an authorized body of state power of a constituent entity of the Russian Federation) upon the proposal of the chairman of the commission. All members of the commission have equal rights when making decisions.

2.4. The composition of the certification commission is formed in such a way as to exclude the possibility of a conflict of interest that could affect the decisions it makes.

2.5. If there is a direct or indirect personal interest of any member of the certification commission, which may lead to a conflict of interest when certifying a particular person being certified, he is obliged to declare this before the start of the meeting. In this case, he does not take part in making a decision regarding a specific person being certified.

2.6. The chairman of the certification commission manages its activities. During his temporary absence, his deputy manages the activities of the commission.

2.7. To ensure the work of the certification commission, its secretary is appointed.

2.8. The schedule of meetings of the certification commission for each quarter is approved by the chairman of the certification commission.

2.9. A meeting of the certification commission is considered valid if at least two-thirds of its roster is present.

2.10. The decision of the certification commission is made by a simple majority of votes. In case of equality of votes, the decision is made in favor of the person being certified. The decision comes into force from the day it is made.

2.11. The duration of certification of a specific certified person cannot exceed 30 calendar days.

2.12. If the person being certified is found to be ineligible for the position of “Head of an educational organization,” the employment contract with him may be terminated in accordance with clause 13 of part 1 of Article 81 of the Labor Code of the Russian Federation on the grounds provided for in the employment contract.

Termination of an employment contract with the head of an organization on this basis is possible if such a basis for terminating the employment contract is provided for in it; if not, then the employment contract should be terminated in accordance with Part 2 of Article 278 of the Labor Code of the Russian Federation.

3. Certification of candidates for the position of head of an educational organization

3.1. The basis for conducting certification of candidates in order to determine their suitability for the position of “Head of an educational organization” may be:

— representation of the head of the municipal (regional) body exercising management in the field of education;

— representation of the collegial governing body of the educational organization;

- statement of the candidate.

3.2. The submission to the certification commission must contain the following information about the candidate:

- Full Name;

— information on advanced training (retraining) (with copies of relevant documents attached);

— motivated, comprehensive and objective assessment of professional, business qualities, results of professional activities based on the professional standard (qualification characteristics) “Head of an educational organization.”

3.3. The candidate's application must contain the following information about him:

- Full Name;

— place of work and position held;

— presence of a qualification category for the position held;

— date of conclusion of the employment contract for the position held;

— level of education and qualifications (with copies of relevant documents attached);

— information on advanced training (retraining) (with copies of relevant documents attached).

To the application, the candidate attaches either a program for overcoming a crisis situation in a specific educational organization, or a program for the development of an educational organization, taking into account the characteristics of its educational activities (gymnasium, school with in-depth study of a specific subject, a school implementing a specific additional pre-professional program, a school implementing inclusive education and etc.).

3.4. During the certification process, the candidate must undergo qualification tests on knowledge of the current legislation on education.

3.5. The candidate for the position of manager must be familiarized with the date, time and place of the certification by the secretary of the certification commission against signature no later than a month before the date of its holding.

3.6. A candidate for the position of manager must be personally present at the meeting of the certification commission during his certification.

If it is impossible to attend a meeting of the certification commission for valid reasons (illness, business trip, etc.), the necessary changes are made to the certification schedule.

3.7. Directly during the certification process, the commission reviews information about the candidate for the position of head contained in the submission (his application), and also assesses the candidate’s suitability for the position of “Head of an educational organization.”

Members of the certification commission, if necessary, have the right to ask the certified person questions related to the performance of the duties of the head of the educational organization.

The secretary of the certification commission keeps minutes of its meeting, which records its decisions and voting results. The minutes are signed by the chairman, deputy chairman, secretary and members of the commission present at the meeting, and are stored as part of a separate file in the municipal (regional) body that manages the field of education.

3.8. Based on the results of the candidate’s certification, the certification commission makes one of the following decisions:

If a candidate fails to appear at a meeting of the certification commission without a good reason or if he is recognized as not suitable for the position of “Head of an educational organization,” he can re-pass certification for compliance with the position of “Head of an educational organization” no earlier than one year after the date of the meeting of the certification commission.

3.10. The certified person becomes familiar with the certification results, documented in the protocol, against signature.

3.11. For everyone who has passed certification, an extract from the protocol is drawn up containing the following information: last name, first name, patronymic of the person being certified, his place of work and position, the date of the meeting of the certification commission, the results of voting when making a decision, which is signed by the secretary of the certification commission. An extract from the protocol and the presentation (application) are stored in the personal file of the person being certified.

3.12. A candidate recognized as appropriate for the position of “Head of an educational organization” based on the results of certification may be:

- appointed to the position of manager;

— included in the reserve of managers.

4. Certification of the head of an educational organization

4.1. The decision to conduct certification of the head of an educational organization is made by the founder if the following grounds exist:

— repeated violations by the head of the current legislation, confirmed by documents;

— negative dynamics of the results of students mastering implemented educational programs in comparison with previous periods in the same educational organization, documented;

- justified, confirmed complaints from students (their legal representatives) about the low performance indicators of the educational organization.

4.2. Certification of the head of an educational organization is carried out on the basis of a submission to the certification commission by his immediate supervisor.

4.3. The following managers are not subject to certification:

- those who have worked in the position for less than one year;

- pregnant women;

— women on maternity leave;

- those on parental leave until the child reaches the age of three;

- absent from work for more than four months due to illness.

Certification of managers listed in subparagraphs “c”, “d” and “e” is possible no earlier than one year after they start working.

4.4. The submission must contain the following information about the manager:

- Full Name;

- place of work;

— date of conclusion of the employment contract and its validity period (for a fixed-term employment contract);

— level of education and qualifications;

— information on advanced training (retraining);

— motivated, comprehensive and objective assessment of professional, business qualities, results of professional activities based on the professional standard (qualification characteristics) “Head of an educational organization”;

— the reason that served as the basis for the certification.

4.5. The head of the educational organization must be familiarized with the submission by the immediate supervisor against signature no later than a month before the day of certification. After reading the submission, the head of the educational organization has the right to submit to the certification commission his own information characterizing his work activity over the past three years, as well as a statement with appropriate justification in case of disagreement with the information contained in the submission of the immediate supervisor.

If the head of the educational organization refuses to familiarize himself with the submission, a corresponding act is drawn up, which is signed by the immediate supervisor and the persons in whose presence the act was drawn up.

4.6. The head of the educational organization must be personally present at the meeting of the certification commission during his certification.

If the manager is unable to attend a meeting of the certification commission for valid reasons (illness, business trip, etc.), appropriate changes are made to the certification schedule.

If a manager fails to attend a meeting of the certification commission without a valid reason, the commission has the right to conduct certification in his absence.

4.7. The certification commission considers information about the certified person contained in the submission, his statement with appropriate justification in case of disagreement with the submission, and also assesses his compliance with the requirements of the professional standard (qualification characteristics) “Head of an educational organization.”

Members of the certification commission, if necessary, have the right to ask the certified person questions related to the performance of his official duties.

The secretary of the certification commission keeps minutes of its meeting, which records its decisions and voting results. The protocol is signed by the chairman, deputy chairman, secretary and members of the certification commission present at the meeting, and is stored as part of a separate file in the municipal (regional) body that manages the field of education.

4.8. Based on the certification results, the certification commission makes one of the following decisions:

— corresponds to the position “Head of an educational organization”;

- does not correspond to the position “Head of an educational organization.”

4.9. The certified person becomes familiar with the certification results, documented in the protocol, against signature.

4.10. The certified person has the right to appeal the results of certification to the court in accordance with the legislation of the Russian Federation.

4.11. For everyone who has passed certification, an extract from the protocol is drawn up containing the following information: last name, first name, patronymic of the person being certified, his place of work and position, the date of the meeting of the certification commission, the results of voting when making a decision, which is signed by the secretary of the certification commission. An extract from the protocol and the presentation (application) are stored in the personal file of the person being certified.
