Grants are cash or other funds transferred free of charge and irrevocably by citizens and legal entities, including foreign citizens and foreign legal entities, as well as international organizations that have acquired the right to provide grants on the territory of the Russian Federation in accordance with the procedure established by the Government of the Russian Federation, to conduct specific scientific research on the terms provided by the grantors. (Federal Law No. 127-FZ of August 23, 1996, Art. 2)

Grants are given to scientists, scientific organizations, educational institutions higher professional education, other legal entities and citizens. In Moscow, for example, there is a regulation on Moscow grants in the field of science and technology in the field of education ( approved by the Decree Government of Moscow dated October 30, 2001 992-PP "On the mechanism for distributing Moscow grants in the field of science and technology in the field of education"), which provides for the allocation of Money from the city budget on a competitive basis free of charge and irrevocably to an individual or legal entity (grant recipient) in order to financially support the best achievements, projects or programs in the interests of developing the city education system and disseminating its positive experience.

In addition, there are so-called charitable grants, which are defined in federal law dated August 11, 1995 No. 135-FZ "On charitable activities and charitable organizations" (hereinafter referred to as the Law on Charitable Activities).

Charitable grants are donations of a targeted nature and provided by citizens and legal entities in cash or in kind (Article 15 of the Law on Charitable Activity).

From the moment it is received, the grant, like any other donation, is the property of the grantee.

Small business grants: where to find and how to get

Grant recipients dispose of them in accordance with the legislation of the Russian Federation or, if they are used on the territory of a foreign state, in accordance with the legislation of that state, as well as on the terms on which these grants are allocated.

All grant funds provided free of charge to individuals and organizations in order to support science, education and culture and for other purposes must be spent exclusively for the purposes indicated when the grant was allocated, and cannot be used for any other purposes without the written consent of the grantor (donor ).

The organization that received the grant is obliged to use it for its intended purpose and submit full and comprehensive reports on the activities for the implementation of the grant. If it is impossible for the grantee to participate in the implementation of the grant, the donor organization stops further funding of the grant.

For the purposes of accounting and taxation, the grant refers to the means of targeted financing.

Based on the foregoing, we emphasize that not all donated funds can be classified as grants, but only funds provided free of charge for scientific or other research, development work, training, treatment and other purposes, followed by a report on their use.

In other cases, the amounts of funds received free of charge from other enterprises and organizations are not grants.

2 Taxation of funds received in the form of grants

For tax purposes, the concept of "grant" is established in subparagraph 14 of paragraph 1 of Article 251 of the Tax Code of the Russian Federation, according to which funds or other property are recognized as grants if their transfer (receipt) satisfies the following conditions:

grants are provided on a gratuitous and irrevocable basis individuals, non-profit organizations, including foreign and international organizations and associations according to the list of such organizations approved by the Government of the Russian Federation;

grants are provided for the implementation of specific programs in the field of education, art, culture, protection environment, as well as to conduct specific scientific research;

· grants are provided on terms determined by the grantor, with the obligatory submission to the grantor of a report on the intended use of the grant.

Thus, subparagraph 14 of paragraph 1 of Article 251 of the Tax Code of the Russian Federation defines the conditions for the transfer (receipt) of funds or other property, under which funds or other property are recognized as grants. Simultaneous observance of these conditions is mandatory for attributing donated funds to a grant and applying the appropriate taxation procedure provided for by the Tax Code of the Russian Federation for grants.

3 Providing a grant by a foreign or international organization

One of the conditions is the provision of grants by foreign and international organizations, which are included in the list approved by the Government of the Russian Federation. The list was approved by Decree of the Government of the Russian Federation of December 24, 2002 No. 923 "On the list of foreign and international organizations whose grants are not taken into account for tax purposes in the income of Russian organizations that receive grants."

Receipt of grants from a foreign or international organization is exempt from income tax if their transfer (receipt) satisfies certain conditions:

· grants are provided on a gratuitous and irrevocable basis by foreign and international organizations included in the List;

· grants are intended for the implementation of specific programs in the field of education, art, culture, environmental protection, as well as for specific scientific research;

the grants were used for the purpose determined by the grantor, with mandatory submission to the grantor of a report on the intended use of the grant.

Funds received free of charge that do not meet the specified conditions are subject to inclusion in the tax base for income tax as income.

The organization entered into with U.S. Russia Investment Fund contract, according to which it received 40,958 US dollars from the latter free of charge, which in ruble terms amounted to 1,251,080 rubles. At the same time, the parties under this contract defined this amount as target financing in the form of a grant and determined the purpose of its use - "repayment of loans received in 1999-2000 for the purchase of equipment for its subsequent leasing."

The concept of "grant" should be understood not in the legal sense given to it by the parties in the contract on targeted financing, but in the way the state defines this concept in public law relations, including for taxation purposes.

Recall that for the purposes of applying Chapter 25 of the Tax Code of the Russian Federation, grants (gratuitous assistance) are understood to be amounts provided to support science and education, culture and art in the Russian Federation by international or foreign organizations according to the list of such organizations approved by the Government of the Russian Federation.

In this case, the organization's receipt of funds under the contract did not meet these objectives. In addition, the source of targeted funding is U.S. The Russia Investment Fund is not included in the list of international and foreign organizations whose grants (gratuitous aid) received by taxpayers and provided to support science, education, culture and art in the Russian Federation are not subject to taxation, which was approved by the Decree of the Government of the Russian Federation of December 24, 2002 No. 923 "On the list of foreign and international organizations whose grants are not taken into account for tax purposes in the income of Russian organizations that receive grants."

The granting organization is not included in the above list approved by the Government of the Russian Federation; funds in foreign currency received by the organization for tax purposes do not belong to targeted financing. In accordance with paragraph 8 of Article 250 of the Tax Code of the Russian Federation, for tax purposes, the above funds are considered property received free of charge and are subject to inclusion in the tax base when calculating income tax as part of non-operating income (see Resolution of the Federal Antimonopoly Service of the North-Western District of November 26, 2003 in case No. A56 -6447/03).

In general, certain forms of support are a very tempting thing for people who have just started entrepreneurial activity and, accordingly, do not have any special experience or start-up capital.

After all, the conditions for issuing funds are much softer than in a credit institution. However, we want to warn you against excessive euphoria. In fact, not everything is so rosy. And the point here is not even corruption and support only for "their" people with "necessary" projects. This, unfortunately, also takes place, although the significance of corruption (at least in this area) is greatly exaggerated. But there are plenty of other problems.

Obstacles and disadvantages

  • A lot of formalities when applying for a project that applies for a grant.
  • The need to report on the amounts spent (often - only according to the plan, deviations are unacceptable).
  • Usually, more or less large amounts are transferred to legal entities and individual entrepreneurs only on a competitive basis. The names of the competitions can be different - from the "Fair of Innovative Enterprises" to the "Development of Tourism in the Gadyukinsky District". Each such event may or may not have its own specifics. The fact that the word "innovation" is indicated in the name of the "distribution of elephants" does not mean at all that only business plans where there is know-how will be admitted.
  • In addition to the previous point: very often, not very competent people manage the issuance of funds. Novelty, on the contrary, can scare them away. The author of this article was in a couple of competitions, where an excellent IT project took almost the last place, and a novice businessman became the happy owner of 250,000 rubles, whose strategy was to buy 2 sawmills and hire 2 people to service them.
  • Although many events in districts and regions are held regularly, very often their conditions and formal requirements change. In many ways, this is a tool of "legal corruption." By hiding the necessary nuances deep, deep on the website of a "business incubator" or other organizing structure, you can weed out the lion's share of applicants. And the right people, of course, will be in the know. And everything will turn out honestly - only their business plans will meet all the criteria.

As you can see, getting money for business from government agencies is not so easy. It often takes so much time and effort to prepare for the submission of documents and the presentation of your brainchild that it is sometimes easier to earn an amount similar to the grant simply by unloading the wagons.
